Domestic Violence Charges Filed Against Darren Collison
Domestic violence charges were filed today against Sacramento King’s player Darren Collison of Granite Bay. The charges are related to a May 30th, 2016 incident where Collision was arrested at his home. The initial reports were submitted to our office for review by the Placer County Sheriff’s Office on June 1st, 2016. Our office additionally requested and received photographs of the victim’s injuries in the case and a copy of the 911 call made by the victim on May 30th, 2016. After review of the all the above evidence we have concluded there is sufficient evidence that will allow our office to file and prove this criminal case against Mr. Collison beyond a reasonable doubt.
The Penal Code allows a defendant to be charged with a felony or misdemeanor in cases where the domestic violence resulted in an injury to the victim. The California Rules of Court outlines the relevant factors that serve as the basis of that decision. The predominant factors in a domestic violence case are the past criminal record of the defendant particularly of prior convictions that are violent in nature and the severity of the injuries.
Considering the above factors including the lack of any prior criminal history of Mr. Collision and the fact the injuries suffered by the defendant, while concerning, required little if any medical attention, dictate this case be charged as a misdemeanor. Accordingly Mr. Collision has been charged with one count of violating 273.5 of the Penal Code (domestic violence causing injury). Mr. Collision has also been charged with one count of Domestic Battery of a Spouse in violation of Penal Code 243(e), in a closely related, but separate incident occurring on the same evening. Mr. Collision is also charged with one count of Vehicle Code 14601.1(a) (driving on suspended license) regarding his failure to appear on April 21st, 2016, this is related to a separate incident.
Mr. Collision faces up to one year in county jail, as well as, other terms and conditions, such as a one year batterer’s treatment program if convicted. Mr. Collision’s scheduled arraignment date is on July 11th, 2016 in Department 31 of the Placer County Superior Court. Mr. Collision is currently out of custody after posting $55,000 bail.
Our office has understandably received and refused requests to discuss Mr. Collision's case from the representative of Mr. Collision, the NBA, and the media. Our ethical guidelines do not allow us to disclose facts and details of the case outside the legal process and the courtroom. While the facts of the case will ultimately become available throughout the court process, our office has an obligation to assure Mr. Collision receives a fair trial by not revealing details of the case outside of the court process. Accordingly, any request for evidence or information regarding the case from anyone except the court and Mr. Collision’s counsel of record will be denied. We will provide information regarding the dates and subject matter of future court hearings or changes in the status of the case.
